Tax clearance and the TCS PIN: the certificate that expires without telling you
Four issues in, and the pattern holding steady is this: nothing that's disqualified a real bid so far has been about price, or workmanship, or even experience. It's been paperwork with a shelf life. This week's is the one with the shortest shelf life of all.
What's actually being checked
Since SARS moved to the electronic Tax Compliance Status (TCS) system, bidders no longer submit a static tax clearance certificate — they submit a TCS PIN, which the evaluating entity uses to pull your live compliance status directly from SARS at the time they check it. That's the detail that trips people up: it isn't a document you attach and forget. It's a live lookup.
That means your TCS PIN reflects your tax status on the day someone checks it — not the day you generated the PIN, and not the day you submitted the bid.
Where contractors get caught
- Generating the PIN too early and assuming it's locked in. If your compliance status changes between submission and evaluation — a missed provisional tax payment, an outstanding return — the PIN can reflect "non-compliant" even though it looked fine when you submitted.
- Confusing the PIN with the certificate. Some bidders still attach an old-style printed tax clearance certificate out of habit. Most current tender documents specifically request the TCS PIN — check the exact wording of the SBD form rather than assuming either format is interchangeable.
- Outstanding returns, not outstanding payment, being the actual issue. A contractor can be paid up and still show as non-compliant on SARS's system simply because a return wasn't filed — an easy thing to overlook if your bookkeeping and your tax filings aren't tightly synced.
- Company-level compliance vs. director-level compliance. Depending on the entity type, SARS compliance checks can extend beyond the company itself — worth confirming with your accountant or tax practitioner exactly what's being assessed.
Before you commit time to a proposal
- Generate or refresh your TCS PIN as close to submission as practically possible, not weeks in advance.
- Confirm with your accountant or tax practitioner that all returns — not just payments — are current, since that's the less visible failure mode.
- Check the tender document's exact requested format (PIN vs. certificate) rather than defaulting to whatever you used last time.
Unlike an unsigned form, this one isn't fixable in the final 48 hours if your returns aren't current. It's worth checking today, tender or no tender.
